TARAPOTO, Peru?For tropical ecologist Gregory Asner, flying over the Peruvian Amazon from the town of Tarapoto is like traveling back in time. Modern houses, rice paddies and oil palm plantations give way to steep, forested mountains and then to green, unbroken forest that curves toward the horizon.

Suddenly the tree canopy below the twin-engine plane turns a mottled gray-brown, a sign of drought damage that he estimates may affect as many as half the trees.

In this remote corner of Peru?s Ucayali region, Asner, a tropical ecologist at the Carnegie Institution for Science at Stanford University, is afraid he is seeing the future. In the last few years this patch of forest has been hit by two ?once-in-a-century droughts??one in 2005 and another in 2010. These dry spells may become more frequent as temperatures in the tropical North Atlantic Ocean rise and as humans burn thousands of square kilometers of forest for farming. Although it has seen warmer temperatures in the past, the western Amazon is under siege now from a combination of a warming climate and human population growth that it has never faced before, and scientists are scrambling to determine whether existing protected areas will be enough to buffer against the changes to come.

Behind the plane Asner glimpses smoke rising from fires set to clear land for farming. Migration from the Andean highlands has boosted Peru?s Amazonian states to the top of the population growth chart, and the influx of people is taking a toll on the forest.

Peru?s Ministry of Environment?using satellite images and Carnegie-provided software?calculates that the country lost about 6,475 square kilometers of forest, an area the size of Delaware, between 2005 and 2009, up from some 4,550 square kilometers in the five previous years. Losing forest reduces precipitation, further stressing the remaining trees. ?About 50 percent of the rain that falls in the Amazon is generated by the forest itself, through transpiration and evaporation,? Asner says. ?Deforestation exacerbates the drought problem, because it removes that internal engine.?

Clearing fields and pastures also leaves more exposed forest edges, drying out the interior and making it more likely to burn if an agricultural fire escapes. Fires during the 2005 and 2010 droughts added 3.8 gigatons of carbon to the atmosphere, according to Simon Lewis, a forest ecologist at University College London. In recent genetic studies Lewis found that Amazonian trees have weathered past climatic warming, but the changes were slower then and were not exacerbated by humans, he says.

Faced with warmer, drier conditions, trees have three options:

?Individuals can acclimate, species can adapt or migrate, or they go extinct,? says Kenneth Feeley, a biologist at Florida International University. A floral species can expand its range into a cooler region, but only as fast as seed dispersal allows. Feeley, who studies trees on the eastern slope of the Peruvian Andes, was surprised to see range changes there in just a few years. ?Species are moving upslope about three vertical meters a year?that?s really fast,? he says, although perhaps not fast enough. ?Based on the climate change that?s already happening, they need to move nine or 10 vertical meters a years.?

In the lowlands, deforestation reduces the areas to which species can move, and fields, pastures and roads create barriers to dispersal. Peru has some large protected areas, such as Man? National Park, where Feeley does his work, but scientists don?t know if they are big enough?or in the right places?to allow species to migrate in a rapidly changing climate.

CAIRO (AP) ? Egypt's president ordered parliament's upper chamber to convene after the release of official results of a referendum on an Islamist-backed constitution that gives temporary legislative powers to the traditionally toothless chamber.

The results had been expected on Monday but were not released and the electoral commission has not yet set a date to announce them. The Muslim Brotherhood, the main group that backed the charter, said it passed with 64 percent of the vote ? a result likely to be confirmed by the official result.

Parliament's upper house, the Shura Council, cannot convene before the official word that the constitution has passed.

The new constitution would give the Shura Council powers to legislate until the lower house is elected within the next two months. President Mohammed Morsi has held legislative powers for months now since a court disbanded the lower house of parliament.

Over the weekend, Morsi appointed 90 members to the Islamist-dominated Shura Council, in an attempt to make the body more representative.

The 90 include at least 30 Islamists and a dozen minority Christians. The council now has a total of 270 members, two-thirds of them elected. Critics, however, say most of the representatives are either Islamists or their supporters.

The council was elected last winter in a vote with an extremely low turnout of less than 10 percent of Egypt's 51 million eligible voters.

The council is expected to prioritize the passing of a new law on the rules for parliamentary elections. The former lower house, the first to be elected after the uprising that forced President Hosni Mubarak out of office nearly two years ago, was dissolved after a court order ruled the law governing election of its members was unconstitutional.

The passage of the disputed constitution following a month of political bickering has left Egypt more polarized and poised for continued tension. The opposition has already vowed to challenge the results of the referendum, alleging fraud and violations in the voting.

Critics say the new constitution seeks to enshrine Islamic rule in Egypt and accuses the Islamists of trying to monopolize power.

They say the charter does not sufficiently protect the rights of women and minority groups and empowers Muslim clerics by giving them a say over legislation. Some articles were also seen as tailored to get rid of Islamists' enemies and undermine the freedom of labor unions.

Morsi and his supporters say the constitution is needed to restore stability in the country, restore an elected parliament and build state institutions.

(AP) ? Now that marijuana is legal in neighboring Washington state, Portland police are offering some helpful advice to Oregon pot users. Sure, you can go over to Washington state to "smoke some weed," a police advisory states, but you might get arrested for driving under the influence if you're pulled over coming home, even if you're on a bike.

And if you are among the 55,000 people with an Oregon medical marijuana card, Portland police say you'll be able to get your allowed amount of medicine in Washington state. Still, even though you now can't get busted for toking in Tacoma or elsewhere in Washington (though you could get a ticket for public use), it will be a year before selling or buying it is legal.

As the Evergreen state works out the various complications of its new law ? including the fact that marijuana is still illegal under federal law ? neighbors of Washington are watching with curiosity, and perhaps some apprehension.

If the federal government doesn't attempt to intervene in the new law, and if Washington state sets up a supply system whose mechanics are yet to be defined, Washington may well become a greater source of pot for users in Oregon and Idaho.

"It would be like a place people go to get cheap beer. We're not talking about medical marijuana. We're talking about people who just want to get high," said Josh Marquis, district attorney for Oregon's Clatsop County.

Marquis is not totally opposed to marijuana. He thinks the federal government should do what Oregon has done: decriminalize possession of small amounts, and allow people with genuine medical needs to have access for treatment.

But one of his greatest concerns, echoed by other law enforcement officials, is people going over to Washington to obtain weed and driving home stoned.

"If I'm going to drive on the Oregon coast at night, in the driving rain, I want the person on the other side of the road to be completely unimpaired," Marquis told The Associated Press.

Idaho law officials are also watching what's happening in Washington state. Unlike Oregon, Idaho has no medical marijuana law and possession in any form is against the law. Simple possession of less than three ounces is a misdemeanor, punishable by up to a year in jail and a $1,000 fine.

Idaho officials already have their hands full with Idahoans obtaining medical marijuana cards out of state. The Gem State borders three medical marijuana states, a reality that has caused medical marijuana arrests to outpace those of traffickers or other users.

Although Idaho is a largely conservative state, there are pockets defined by borders and demographics that could create new challenges for law enforcement.

One of them is Moscow, home to the University of Idaho campus and more than 11,000 students ? just a 10-minute drive to the Washington State University campus in Pullman. More than 70 miles to the north is the busy suburban corridor connecting Spokane, Wash., and the Idaho cities of Post Falls and Coeur d'Alene.

Idaho police say increased arrests for marijuana could intensify stress on county jails and caseloads for county prosecutors.

Idaho State Police Lt. Chris Schenk, says people in north Idaho are joking about so-called "pot tourists" crossing the border to take advantage of Washington's relaxed law. But he says it's going to take time to gauge any increases in arrests for possession or driving under the influence.

Oregon has some of the most permissive pot laws in the nation. Possession of less than an ounce will get you the equivalent of a speeding ticket. And for those who want to go the legal route, they can get a medical marijuana card.

Still, obtaining pot in Oregon is not without its hassles, in the eyes of some who use it.

Federal drug agents have been cracking down on some medical marijuana pot growers, alleging they shipped pot out of state. There has also been pressure on dispensaries that have sprung up in Oregon that provide medical marijuana for a fee to cover costs of operation.. Law officials in some counties have raided such operations, saying they are selling pot for profit.

If Washington state sets up a pot supply system, it is likely some Oregon holders of medical marijuana cards will go north for their medicine, advocates say.

In Canada, another Washington neighbor, pot is illegal under federal law. Border enforcement of drug laws is stringent, but enforcement for possession for personal use is relaxed. Grass is smoked openly in parks and at pot cafes in British Columbia. Distribution of medical marijuana to patients with needs deemed legitimate through pot dispensaries is also allowed

A spokesman for the Royal Canadian Mounted Police, Sgt. Duncan Pound, said it is too early to predict what effects legalization in Washington will have.

A marijuana advocate in British Columbia, Jodie Emery, worries Canada might intensify border controls because of Washington's weed legalization.

Emery also speculates that legalization in Washington could lessen the flow of people traveling to Vancouver, British Columbia to try some "BC Bud."

"British Columbia does have a lot of tourism for people who want to experience the marijuana culture but that is shifting," Emery said.

Back in Oregon, the tip sheet to marijuana users issued by Portland police states that possession of less than an ounce has been a "low law enforcement priority for 35 years in Portland and this will not change due to the new Washington law."

But the advisory also has this caution: If you go to Washington to "buy some weed," the "Portland Police Bureau cannot predict or control the enforcement activities of federal authorities."

Cincinnati hires Tuberville as football coach

CINCINNATI (AP) ? Tommy Tuberville wasn't expecting a call from an old acquaintance. A few hours later, he was headed north for a new job.

Tuberville left Texas Tech to become Cincinnati's football coach Saturday, moving away from a Big 12 school to one that has an uncertain future with conference realignment. He left the Red Raiders after three years to coach at a school where his recent predecessors have lasted no longer.

Two hours after Cincinnati's 11th-ranked basketball team won its ninth game of the season, the Bearcats hauled out their Big East trophies and held a pep rally ? complete with cheerleaders, band and several hundred fans ? for the new coach at midcourt.

"There's always a next step," Tuberville said. "I'm going to get the question: Why did you come to Cincinnati? That's exactly it."

His quick hiring ended a whirlwind week in Cincinnati, which had won a share of its fourth Big East title in the past five years a week earlier. Coach Butch Jones interviewed at Purdue and Colorado before accepting the job at Tennessee on Friday morning.

Athletics director Whit Babcock had Tuberville ? whom he worked with for three years at Auburn ? at the top of his list of candidates. Working on two hours of sleep, Babcock called Tuberville on Saturday morning to see if he was interested.

"I was perfectly satisfied," Tuberville said. "I had a great home in Lubbock, Texas. The people of west Texas are great people, they love football. Our football team played hard. ... But there was something when Whit called that I thought, 'You know? Let me think about this.'"

Texas Tech athletics director Kirby Hocutt was stunned when Tuberville called to tell him he was leaving.

"The first indication I got was at 10:32 this morning when he called me," Hocutt said. "Tommy and I have talked a number of times since the conclusion of the Baylor game this year, and as recently as yesterday he looked me in the eye and gave me his commitment and dedication to Texas Tech football and leading this program forward."

Both teams are headed to bowl games with their coaching staffs in flux.

The Bearcats (9-3) held their first practice on Saturday for the Belk Bowl against Duke. Players heard the news while eating lunch after practice.

"We had a real smooth practice," senior quarterback Brendon Kay said. "We knocked the rust off from not practicing for a week. After practice, I was in the locker room and then eating lunch, it came on (television). We said, 'Wow, this is real.'"

Tuberville won't coach the Bearcats in their bowl, leaving it up to the staff.

Tuberville went 20-17 in three seasons at Texas Tech, after coaching at Mississippi and Auburn. The Red Raiders (7-5) will play Minnesota in the Meineke Car Care Bowl after missing out on a bowl last season.

By hiring the 58-year-old Tuberville, Cincinnati broke with its recent practice of attracting up-and-coming coaches from smaller conferences. The last three coaches left after three years each ? Mark Dantonio came from Ohio State and left for Michigan State; Brian Kelly came from Central Michigan and went to Notre Dame; Jones succeeded Kelly at both Central Michigan and Cincinnati.

Like Kelly and Jones, Tuberville likes a wide-open offense. The Red Raiders ranked second nationally with 361.9 yards passing this season.

His final season at Texas Tech was marred by a sideline outburst. Tuberville lost his temper with graduate assistant Kevin Oliver during a 41-34 win over Kansas.

Tuberville appeared to strike Oliver after the Red Raiders had trouble getting the right players on the field. Tuberville said he grabbed Oliver's headset, but wished he'd handled the situation better.

The Bearcats hope his hiring allows them to end their streak of losing football coaches every few years. He agreed to the framework of a five-year deal, with details still to be worked out.

The university has been disappointed by the Big East's massive exodus and lobbied to get into the Atlantic Coast Conference. Instead, rival Louisville got accepted by the ACC, leaving Cincinnati hoping it could make the move in a few more years.

Tuberville wasn't put off by the conference uncertainty, saying he wants to get the program to the point that "anybody would be proud to have Cincinnati in whatever conference is out there.

"But we're excited about where we at right now. Things will change and they're going to change every day for the next few years, and everybody knows where it's headed."

There's also a lot of work to do on the athletic facilities.

During Jones' tenure, Cincinnati expanded its football facility, adding a practice field with a protective bubble for bad weather. The school is trying to figure out how to upgrade 35,000-seat Nippert Stadium, which is the second-oldest playing site in the nation for a college team behind Penn's Franklin Field. Nippert has been in use since 1901.

Despite their Big East success, the Bearcats have played in front of disappointing crowds at Nippert. They drew only 21,171 fans on senior night ? their smallest crowd of the season ? for a 27-10 win over South Florida this year.

Machines with built-in copy protection

ScienceDaily (Dec. 7, 2012) ? Pirated goods cost German industry billions, and expensive industrial goods like machining systems are becoming a growing target. Scientists are turning the tables on the forgers by studying their methods and developing anti-counterfeit solutions.

The annual cost to industry of illegal copies of branded products is estimated at a staggering 650 billion U.S. dollars worldwide, and German machine tool manufacturers are becoming an increasingly popular target for pirating operations. Around one third of all companies have seen their business eroded by cheap imitations of their products, especially manufacturers of textile machines, compressors and plastics processing equipment. "Most companies have absolutely no idea just how easily their products can be copied," says Bartol Filipovic, head of the Product Protection department at the Fraunhofer Research Institution for Applied and Integrated Security AISEC in Garching near Munich. The AISEC advises companies on how best to protect their products and IT services from unlawful attacks on their proprietary rights.

In the world of industrial machines, there are forgeries of almost everything that can be copied, from housing design to instruction manuals. The most critical elements are those that give a product its "intrinsic value": electronic circuits and software that constitute its distinctive characteristics. This makes embedded systems with measurement, control, or signal processing functions prime targets for forgers. Product pirates tend to steer clear of getting their own hands dirty, preferring to engage the services of those offering "reverse engineering." This involves performing the same development process only in the opposite direction, which begins by analyzing exactly how the hardware is put together and creating circuit diagrams of the original product. Reverse engineers can then rip the software and reconstruct the machine's control system and functions, thereby gaining access to the manufacturer's key know-how.

In addition to conducting research, AISEC's most important role is instructive. Many companies react only once counterfeits of their own products have surfaced on the market. Although it is then too late to prevent fake copies, it is possible to tag the original so that it can be distinguished from imitations. The aviation industry marks safety-critical spare parts with copy-resistant holograms; it is also possible to build a kind of indelible electronic fingerprint into the circuit. But taking any number of safety precautions is not going to be enough to deter manufacturers of fake products, and trade in them can only be stopped when customs officers, distributors and customers are all equipped with the devices needed to read and decode the markings. As this is often not the case, companies should see to it that suitable protection mechanisms are placed deep within the hardware when developing each new product range. The optimum scenario is for clients to consult AISEC before completing this phase, and have their developers share the proposed hardware setup, circuit diagrams and software with AISEC's product protection team -- in strictest confidence, of course. AISEC's researchers analyze this information to identify any weaknesses and offer suggestions for making the product more secure.

Targeted technical methods guard against forgery

One option is to install cryptographic devices that encrypt the data stored within the machine. These devices generate the corresponding decryption key based on the duration of electrical signals on the microchip. The signals emitted by other chips, even those from the same production batch, will be of a slightly different duration, rendering the key unusable. Another option is to use hardwired control units. These purpose-built chips make it extremely difficult for offenders to rip the software and run it using standard chips built into product imitations. However, it is possible for companies to safeguard computer programs without the need for special hardware; for instance by adopting obfuscation techniques. It is definitely worthwhile for companies to analyze and develop suitable technical safeguards, says Bartol Filipovic. "The service we provide is less costly than the damages inflicted by product piracy." The cost of such services varies according to the scope of analysis and the extent of the protection required.

Through its advice, AISEC aims to buy companies as much time as possible. Companies that have implemented AISEC recommendations enjoy at least five to ten years relief from attacks by product counterfeiters. This time lead is crucial for companies to protect their expensive investments. The technological know-how required to manufacture industrial goods does not go out of date as quickly as that for consumer goods, making it thoroughly worthwhile for forgers to copy a machine even if it has already been on the market for five years. Equipping goods with the latest protection methods means that forgers would simply be wasting their time. "I'm not aware of a single case where someone has successfully broken through our safeguards," says Filipovic.

California Child Support Guidelines Triggered in Interstate Divorce


????December 07, 2012 /24-7PressRelease/ -- Among the many complexities that can arise during the divorce process, arguments over which state's laws apply to the dissolution can be particularly challenging. From out-of-state child custody and visitation determinations to spousal support durations, choice of venue in a divorce case frequently has major implications.

A recent case before the California Court of Appeal, In re Marriage of Barth, involved a dispute over child support in a divorce that originally arose in Ohio. In the end, the husband, who was successful in having the case removed to California, ended up paying significantly higher amounts of child support. In fact, the court's opinion began with, "If ever there was a case where the adage 'be careful what you wish for' applied, this is surely it."

The couple was married for 15 years and had two children before the wife filed for divorce in 2004 based on the husband's admission of extramarital affairs. The family had recently moved to California, and the wife immediately returned to Ohio with the children upon discovery of her husband's infidelity.

Both spouses filed for divorce on consecutive days. The wife filed first in Ohio, followed by the husband a day later in California. After a hearing based on the Uniform Child Custody Jurisdiction and Enforcement Act, the California family court proceedings were stayed pending the outcome of the Ohio proceedings.

The Ohio court ruled that it had jurisdiction over the matter, based in part on the father's frequent business presence in the state and the fact that he often stayed in a house located near his wife that he had helped his mother purchase. The court awarded primary custody and $1,600 in monthly child support to the mother.

The father appealed and finally prevailed in 2007 when the Ohio Supreme Court held that the mother had changed residency upon moving to California and had not been back in Ohio long enough to meet its six-month residency requirements before filing a divorce action. After the Ohio case was dismissed, the father successfully petitioned to have the stay lifted on his California divorce petition.

Resolving complex out-of-state child support and custody issues

The primary issue arising out of the California divorce proceedings was whether the father should be required to pay child support retroactive to the date of his original petition back in 2004. The father, who represented himself in the proceedings, argued that this should not occur because the mother had initially defaulted by not responding to the California divorce summons.

The family court disagreed with this argument, and the Court of Appeal agreed. The lower court had rejected many of the father's arguments regarding his changed financial circumstances due to his claim that he had lost his job because of his many travels to Ohio to defend his interests in the original divorce proceedings. The appeals court therefore affirmed the lower court's finding that the father was responsible for between $2,253 and $7,239 in retroactive monthly support under California's child support guidelines. The large difference in monthly support amounts was due to the fluctuating income of the parties and changes in child custody arrangements from 2004 to 2007.

The Court of Appeals also upheld the lower court's imputation of income to the father in excess of eight times what father had reported to the court. The lower court found that the father deliberately misled the court regarding his income "for the purpose of skewing the court's calculation of guideline child support." The father was a CPA and owned several businesses. Therefore, he prepared his own income taxes and used them to demonstrate his income. The lower court determined that the father failed to accurately disclose, on numerous occasions, the actual income he received from all sources.

Legal complexities often arise when parents cannot agree on the amount of child support that should be imposed after divorce, especially when one parent or the other parent with the children lives in another city, state or country. Nearly all states use a guideline formula or calculation to determine child support (per federal requirements), but the exact formula or calculation may differ from state to state. A California divorce lawyer can explain a spouse's rights whether the parents will remain in the same city or one party has moved to another state or out of the country.

?In high school, I used to think all you had to do was write one perfect poem,? said University of Maryland creative writing professor Michael Collier on Wednesday night. ?But that?s not what it?s like at all.?

Collier read some of his poems at Wednesday?s faculty themed Writers Here and Now, which also featured professor Stanley Plumly and assistant professor Emily Mitchell.

The evening began with a Q&A session in the Dorchester basement, where Collier discussed his writing process and evolution as a writer with a group of attentive Writers? House students.

Collier explained what it is like to go back to old novels and poems that inspired him in his adolescence. ?They all become different. That?s the great thing,? he said. ?You can go back and they speak to you in different ways.?

Collier later read his work in Ulrich Recital Hall, including poems that were talked about during the Q&A session, such as ?Cyclops? and ?Labyrinth,? found in his recently published book ?An Individual History.?

The evening continued with a short story reading from Mitchell, who read a piece inspired by guided meditation recordings that were supposed to increase her creativity.??It didn?t work,? she said. ?I started to think about what would happen if the meditation guru were to have a bad day.?

The story that followed was supposed to be a recording of a guided meditater who went off on ridiculous and humorous tangents. The piece kept the audience entertained and often received rounds of laughter.

The night concluded with readings by Stanly Plumly, whom Collier said he has worked with since 1985.

?It would be hard to easily explain our relationship,? he said during the Q&A session. ?To have worked with him for so long has been one of the great gifts in my life.?

Plumly is currently the state poet laureate and the university?s Director of Creative Writing. He read some of his old work and some new poems from his book ?Orphan Hours.??One of his poems was inspired by recent Writers Here & Now featured poet, Paul Guest, who read his poems off a laptop by using a stylus in his mouth.?Plumly?s pieces were well received by the captivated audience.

Wednesday?s Writers Here & Now was the final for the semester. There will be more in February, April and May next semester.
